Terms and Conditions of Production/Supply

  • The Purpose of this document is to establish a contract between JAW Media Productions Limited hereinafter referred to as PRODUCER, and, You (or your company) hereinafter referred to as CLIENT for the production of a media product hereinafter referred to as the PROJECT.
  • PRODUCER offers to produce the PROJECT for CLIENT in exchange for valuable consideration as specified in Paragraph 9 below.
  • The PROJECT and it’s purpose is as detailed in the quote provided to you before taking out this contract. No other use of the project is anticipated, nor have terms of consideration been agreed upon to for any but the use specified herein.
  • The PRODUCER shall provide the CLIENT with a written plan, prior to the start of production. CLIENT shall have the right to approve the said plan or stipulate changes thereto in order to make said plan suitable for approval for the CLIENT. Said approval can be by any reasonable means. Email confirmation can be used. Any changes made by the CLIENT to the plan or project after entering into the contract may alter the final billing. This will be discussed if changed.
  • PRODUCER shall, subsequent to plan or estimate approval, exercise sole discretion in the hiring and firing of the cast(if applicable), crew and other production staff. The producer assures the highest possible standards of production for the specified budget.
  • CLIENT shall approve the written production budget/quote submitted in advance by the PRODUCER via email/digital means. PRODUCER warrants that the production shall cost no more than the grand total listed on a said budget without the prior written consent of the CLIENT. CLIENT reserves the right to increase, not decrease said budget at any time after budget approval.
  • PRODUCER shall submit a production schedule to the CLIENT for approval. Once said production schedule is approved in writing, any deviation or delay therefrom caused by the CLIENT shall be considered unreasonable and any costs for said delay shall be charged to the production budget over and above the original grand total of said budget.
  • PRODUCER insures to provide a finished version of the PROJECT to the CLIENT within a reasonable time frame at the CLIENT’S place of business.
  • The grand total of the production budget for PROJECT approved by the CLIENT is as stated in the quote. Payment shall be made no later than 30 days after completion of the PROJECT. Legal action may take place if this is broken by the CLIENT. Consideration of CLIENT’s own payment procedures will take place before action is started. Duplication services are not included in this agreement.
  • In certain cases, additional licences/permissions may be required to film. Any cost incurred to acquire these are payable by the client and the client is responsible for acquiring these. The videographer cannot be held responsible if the correct permissions have not been sought and so filming cannot take place/can not take place in an expected way.
  • The Videographer shall be granted an artistic licence in relation to the poses photographed/Filmed and the locations used. The videographers judgement regarding the locations/poses and number of images/videos taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
  • The performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control such as but not limited to Illness, weather events, unforeseen events.
  • Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the videographer will not be responsible for photographs or videos that are not produced due to technical failure.
  • In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
  • Any directions issued to clients, their guests or employees during a shoot are deemed to be at said person’s own risk. The videographer cannot be held responsible for any personal accidents during a shoot.
  • All footage remains the property of the videographer unless the client purchases footage and licence for a fee of £400.
  • If the client chooses to buy footage captured, the videographer shall not be held responsible for the transfer of footage and/or the footage captured.
  • Delivery of the PROJECT is within 2 months of all media being captured or received. Delays from 3rd parties cannot be avoided.
  • By agreeing to start any PROJECT you agree to these terms and conditions.
